Here is a conviction i found:

You would think in the case here as it appears NOT to exactly be revenge porn and does NOT at all seem malicious that he maybe lucky enough to get a much more lenient sentence .. perhaps even just a fine.
I believe in cases like this were it was maybe stupidity as opposed to being malicious they often offer a "Bind Over" of a certain time period and amount of money.
e.g. A £100 Bind Over for 12 months. If he keeps his nose clean for 12 months he pays no money and gets no record.

I would think a lot will depend on exactly what he has or does say. For it to be an offence under section 33 there has to be 'intent to cause distress'. Putting a photo online on its own even if a sensible person could see it wasn't a good idea isn't enough.

A person charged with an offence under this section is not to be taken to have disclosed a photograph or film with the intention of causing distress merely because that was a natural and probable consequence of the disclosure.

While there are many things on here that could cause distress, I think the t-shirts are probably safe.

upload the photos to df, and ill take a bloody good look, give me five minutes with them and ill tell you where they originated from.
