how strict are microsoft on repairing consoles that you can see have been tampered with or am i just wasting my time

they arent strict, or at least they havnt been with me. have sent a few with obvious signs of tampering, they replaced with a refurb.

has long has you clean of the anti tamper sticker fully and make sure the tray has the correct colour front you will be fine.

Put it this way what have you got to lose? 2 - 3 weeks without your broken 360.

hmm I think you mean as and not has? you seem to have a problem with that

and it is pretty much hit and miss - as above so long AS you remove all residue from the warranty sticker you may be ok - I have had a couple returned recently because they had been modded / opened (no warranty sticker)
