Help Ebay seller listing removed just after I have paid for it

It was a dashboard video recorder. I paid on 2/2/12 via paypal and the following day, I was advised by an email from Ebay that the listing had been removed. If I had paid for it and had not received it, I can open a dispute to get the money back. Today is only 4th Feb, I am unlikely to get something from China so quickly. The seller responded by asking me to wait 35 days as he had posted it already and do NOT open a dispute.

My question is if I wait for 35 days, would I be to late to claim the money back ? Should I wait this long if the seller is of dubious nature ?

sounds fishy to me mate, i would report it to ebay. why is he asking you to specifically wait 35 days?

whats the sellers feedback like, has he done this before?

if i were you mate, alarm bells would be ringing

Indeed, that's why I start a thread. Just had a message again as it was new year holiday in China, some purchases were sent out late and postal system needs to get back to normality. Some purchasers complain to ebay regarding late or non-delivery. Looks like I can give him a couple of weeks for delivery.

They are selling to the UK. They must adhere to eBays selling rules for the UK. You are well in your right to open a dispute as soon as eBay allows you too, usually 7 days after the esitmated delivery time on the listing (check it, but I doubt it says allow 28 days for delivery!)

If they cannot deliver it within the time frame advertised, chances are you'll get your cash back and it may even still turn up - in 35 days.
He should use a better delivery company, I've had stuff delivered from China within 14 days, so 35 days is just taking the piss.

As for Chinese New Year -
In 2012, Chinese New Year's Day will be celebrated on January 23. The New Year festival will start from January 22 (Chinese New Year' Eve) and end on February 6 (Lantern Festival). 2012 marks the 4710th Chinese New Year, and this time it is the year of dragon according to the Chinese zodiac calendar.

Again, not your fault, he should not be selling stuff on eBay if he's not going to be able to deliver.
Get your cash back as eBay recommends and buy it from somewhere else.

Why wait, open a dispute. If he said he has sent it and it comes all is good, but if it never comes you are covered.
You might end up with goods and refund, then the ball is in your court as to what to do.
