MVNO giffgaff has said customers who continue to download more than 1GB of 'illegitimate' data per hour under its unlimited data plan will be suspended.
The company moved to clarify its data policy after the Advertising Standards Authority (ASA) last week ruled in its favour against claims it misled consumers over its unlimited data packages.
It made a blog posting last night to clarify its stance. Giffgaff claims that any data usage of 1GB per hour is indicative of illegitimate usage, such as tethering. It said: 'This level of usage isn’t always illegitimate, but it’s definitely indicative of it.'
It said when these levels have been detected, it will launch an investigation and email the customer warning them that it suspects illegitimate usage. If the user continues consuming the same levels of data, their data access will be suspended. Consumers can appeal if they feel their data consumption was legitimate.
The MVNO also told customers it was reviewing the internal training and external communications surrounding its data terms and conditions, which should be in place by the end of this week.
