i bought something off ebay that does not work (car related) given mechanics time etc and other work i'm about £200 out of pocket
(not forgetting £258 original purchase price)

my solicitor says i've 100% win chance in claims court

but ebay refuse to give me sellers address where the court documents can be served!!!

how the fuck can i sue the guy???

edit - my apologies - i was really complaining about ebays lack of assistance!

This is not the right place. Pay £25 and join as VIP. There you will have access to the Legal section where Little John will give you proper advice from a lawyers perspective.

Alternatively, get a better solicitor because if your current chap can't even tell you what Ebay are bound to do, then he's not very good. I'm pretty sure if you raise a summons in court (based on a name), then they are legally bound to hand over his details.

well my apologies for posting in the wrong place

i did ask for a mod to move it if appropriate

and thanks but i don't need legal advice - i was just commenting on the lack of 'help' from Ebay

ref 'a better solicitor' - thanks but this practice has for over 50 yrs represented our family business and personal interests in an impeccable manner

Ebay will only release an address to the police - they will not even forward any documents to a third party - they want you to use Paypal 'protection' which is quite frankly poor and offers no 'compensation'!

things are furthermore complicated by the fact that i was referred to Ebay in Dublin which handle all these matters

i just found ebays intransigence appalling - but in this day age age unless you are completely 'off the grid' then you can be found - you appear on too many computer data bases that only the most minimal information is needed to find somebody

btw - don't really like the 'tone' of your reply - not very friendly!

but a shame that ebay refuse to help?

    just for your info

for an action to be 'raised' you have to complete the name and address of the person against who you are raising the action in the court documents???

ergo - forms cannot be submitted without the address !

rather than being 'pretty sure' maybe you should be totally sure before offering advice?

If you have a read around this forum, most of us do our best to try and help, where ever we can. This sometimes means posting things we aren't 100% on, in case they come in useful. At least neo had admitted in his post he wasn't 100% so you knew exactly how to take his post.

At the end of the day, if everyone only answered stuff they could 100% confirm, I for starters wouldn't post anything to help others without confirming it in a reputed textbook, meaning I wouldn't bother trying to help anyone. I bet we have a few experts on a few subjects here, but if none of those see your post that would then mean you have no replies which means no help which means in this case if anyone would be loosing out it potentially would be you.

Personally when I start on a forum, I normally don't post much for a couple of weeks to get a feel for the place and how things are done there.

was the item sent recorded delivery ?
there's usually a return address on the parcel

    or

was there not an address attached to his payment details within ebay ?
i know not everybody leaves their address but if i'm spending a couple of hundred quid with somebody on ebay i'd want an address at least

how did you pay did you use a credit card try taking it up with them if you did you might get lucky

rather than being a tosser with next to no posts maybe you should be polite to established members - that way you may get more help.
