    A friend of mine was involved in a wild party a few weeks ago during which a bunch of guys and girls had an orgy. Snorting Charlie from the girls arses etc. A couple of the photos taken on a phone were shared online. The girls knew they were being filmed and were quite happy to go along with it. I understand two of them are strippers.

    My friend told me one of the girls was upset the photos were shared online and made a complaint to the police. As a consequence my friend has been charged by the police. Not sure the charge but Ďrevenge porní was mentioned. He has denied the charge and told the police he was present but he didnít take the photo and he didnít share it on-line.

    If he did take the photo and he did share it on-line is there any way the police can find this through metadata on the photo? His solicitor thinks they canít and he should be found not guilty but some solicitors havenít a clue about technolo.

    exif data on the photo will show the serial number of the device it was taken on. Isn't it down to the police to prove your friend is guilty and not him proving he is innocent? [Only registered and activated users can see links. ]

    Where were they shared for research purposes?

    When you upload to Facebook and Twitter the image files are processed and all the exif data is removed. If it was just emailed then the data will be intact.

    I think the only way to know for sure, is to post the offending images in this thread. To allow some of the more technically minded members to take a look and offer some advice.

    As mentioned above I think FB's processing removes all data and shrinks files.
    Should be easy enough to do a test and find out.

    Gotta love these "my mate / a friend of a friend" posts.

    I wish it was me (not the charged with the police bit) but it wasn't. The reason I ask is the police don't normally charge people unless they have a reasonable expectation of a conviction.

    I do have some of the photos but not willing to share them until the case is over with. Even then I would pm someone them and it would be up to them to post them.

    I know about the 'asking for a friend bit' but I really am.

    Likely the image was transformed, as above stripped of metadata and compressed.

    The online forum may have a log of the original upload event. If the police were to request this and had a legitimate purpose, ie the absence of this information would result in prejudice to the prevention or detection of a crime then they would lawfully be able to disclose to the police.

    Obviously its possible but I just can't imagine Facebook or the like pointlessly storing a tonne of metadata. I can't see why they would.

    imho If she was a willing participant and knew she was being photographed then she is a silly bitch who should learn a valuable lesson.

    I doubt they would be relying on exif data alone and regardless of that the crime isn't the taking of the photo (unless it's underage or forced) it's the uploading if they are discussing revenge porn and I would suspect they have ip addresses, accounts etc to prove that. I would think his only recourse was to await and see what evidence they have against him when they disclose and then decide on his plea, if he is found guilty or pleads guilty I suspect he also goes on the sex offenders register.

    No. Not through meta data. Through access logs of where the photo appeared maybe.

    Is his case next week or is it a hearing at the magistrates court? it is often if not always the case offenders start in magistrates court for a hearing to establish if it has to go to crown court, scheduled etc and the actual trial or court case may not happen for months after that. Again he needs disclosure to see what evidence they have against him

    As BB has said the prosecution can't just turn up in court and surprise you with evidence which you have not had disclosed to you and your legal team (solicitor). How long has this been going on ? Maybe your mate needs to push his solicitor a bit harder to contact the police/cps as to what exactly the have on you to support the decision from the cps to proceed.....The CPS are the one's who at the end of the day have to decide if the case has a high enough chance of conviction and so make the determination on if public money should be used to go to trial......Sounds a bit convoluted but basically they are bean counters who are "supposed" to chuck out the flimsy/silly/no evidence cases.
    Do the police have his phone ? If not im at a loss as to why this is even going to court and come court day if the prosecution have nothing concrete then his solicitor should have the case chucked out.

    I reckon they have more on your "mate" then he is letting on.

    You may have something there. I've just found out from a third party he text the girl last week and apologised and said he only put it up on snapchat for five minutes and then took it down. It sounds like he's shot himself in the foot because I'd imagine the police can get access to his texts without physically having his phone.

    I would imagine they will have the texts from her phone then. Probably screenshots given the speed at which this is going to court.
