An uninsured driver has been jailed for two years for failing to stop after a car accident in which a child was killed.
Callum John Oakford, nine, died in hospital after being hit by a car in Ferring, West Sussex.
Kamel Kadri, 38 and an illegal immigrant, was jailed for failing to stop after an accident and failing to report one.
Paul Hayward, Crown Prosecution Service spokesman, said there was insufficient evidence to charge the Algerian with dangerous driving.
Callum, known as CJ, was with two other friends when he was hit by a Renault 5 car as they tried to cross a road on New Year's Day.
Witnesses said Kadri had been exceeding the 50mph speed limit on the road as he tried to overtake another car.
But Mr Hayward said: "There has to be clear evidence he was driving in a carless and dangerous manner.
"There was no evidence to support that."
At Chichester Crown Court, Kadri was sentenced to eight months for failing to stop and report the accident and having no insurance or driving licence.
He was given a further 16 months, to run consecutively, for having a false passport and banned from driving for two years.
Judge Anthony Thorpe told him: "I trust that you will be removed from this country as soon as possible after your sentence."
