You have a 5% chance of surviving a impact from a car travelling at 40mph. I wouldnt call that 'fair'. At 116mph there wouldnt be much left.

depends what time of day it was.. i doubt it was like middle of the day, there would be far too much traffic to even approach that speed.. if it was 4am in the mornin or something then hes hardly likely to hit a kid walkin about or anything (not trying to justify his actions here, just wondering if everything has been taken into account).
