Teen Arrested For Sexually Abusing Herself
A fifteen-year-old girl near Pittsburgh took pictures of herself masturbating and posted them on the web. As a result, she was charged with sexual abuse of a child, producing child pornography and distributing child pornography.
I guess the state police in Pennsylvania had nothing better to do this week, or their own porn libraries needed restocking. (They found a lot of pictures the girl didn't post on her computer when they seized it. How much you want to bet those pictures end up on the web, too?)
Look, this is a ridiculous case. The entire theory of child porn laws is to protect the innocent little children. That theory sort of goes out the window when the innocent child is burning through camera batteries to get just the right pose all by herself. Hey, did they seize her diary? I bet she wrote some juicy stuff in there, too, which is a separate crime.
Common sense, people. Oh wait, it's an election year. Forget I said anything.
Update: Oh, and to top it off, because she committed a "sexually violent offense" (defined as including sexual abuse of children and taking sexual pictures of a child) under the Pennsylvania Megan's Law, she is subject to reporting and possible community notification. For the rest of her life.
I hope her parents are rich and can get a good attorney.

Mithras, you're a lawyer; explain to me what part of the constitution denies the right of someone to take pictures of themselves??? I'm sure it's under the commerce clause...
Okay. I'm not sure. Just tell me, which amendment says the federal government has the right to prevent a 15 year old girl from taking pictures of herself and then distribute them at will for no profit to herself or any other entity?
Wait. This is still America right? Having Ashcroft as AG hasn't suddenly caused us to drift backward in time and across space to Victorian England, has it? Oh, wait, fifteen was an old maid back then; must be some other point in time and space...Maybe Taliban ruled Afghanistan?

The Supreme Court says that sexual pictures of young people are obscene. Obscenity is unprotected expression under the free speech clause. Her self-portraits fit the definition of child porn, so therefore ... she's a witch.
