    I did this with the Halifax a couple of months ago, I had accrued £1200 in charges, I had to issue a court judgement through money-claim online but it never got to court, You can even charge them interest at 8% a year, The court fee was £120 but you get that back too, I got £1600 in the end, The whole process only took about 15 days.

    whilst I agree bank charges are extortion, hence why I have done my best to never incur any must be under £100 worth in the last 6 years.

    unfortunately for everyone claiming them, this is going to be offset elsewhere be it in intrest rates on credit cards, savings account or mortgagues, they arent just going to lose this money

    so for people who have ran their accounts with some common sense they end up paying for people who go crazy with their cards

    hopefully though the banks will bring them down to something reasonable like £10 a failed charge as I do agree they are picking on the weakest people with charges

    My dad used to work for a bank & now despises them. This is their main profit making scam raking in billions per year in total, which is then ditributed amongst the fat cats at the top as bonus/dividend. As usual it is the hardest up that get penalised. If you were loaded you wouldn't get penalised as you wouldnt need to go overdrawn.

    Too true.

    How Canardo can blame people that get shafted with stupidly inflated fines for high interest rates is a bit silly.

    Its not their fookin money to be worried about !!

    Im communicating with Lloyds TSB's solicitors at the moment, waiting for them to sed their defence before court.

    Im claiming back £4000, i got these charges over the last 6 years.

    Its easy money and its OUR money, we paid it.

    These bank charges under Common Law are unlawfull.
    Their is no manual intervention therefore an automated charge of £30 for bouncing a direct debit cannot be justified.

    Bounced DD = £30
    Bill that wasnt paid still needs paying...e.g. £30
    Unauthorised Overdraft usage fee as a result of the charge £20
    Thats £80 to pay a £30 bill ????

    With me it wasnt stupidness at all it was lazyness.

    I earned lots of money at the time and had several bank accounts.
    I used 1 bank account for bills and DD's, when the money in that account ran out, i topped it up. But i never checked the account, i just used to put money into it now and again, i got the letters through the door from the bank and didnt worry about them as i knew i could easily pay them.
    Thats how i racked up loads of charges, they didnt worry me at the time.

    But now im a student again, i may as well have them charges back as they are mine, call it a way of investing...lol coz ive added 8% onto every charge they have taken from the day it was taken. Nearly £1000 in interest........sweet. XBox 360 is comin soon, as well as other toys

    Call it what you like mate, its gonna land in my pocket so im not bothered.

    if your on hsbc online you can find 6 yrs on the account there, statements that is

    you can't ask for the interest straight off apparently but if they refuse to give you the money and you go down the small claims court route then you can add interest at 8% as well as the court costs

    Thats right, you initially ask for the charges in all letters.

    Once they refuse blind and point you towards the omnbudsman you add the 8% interest from the day they charged you.

    There is a spreadsheet on the consumer site that works it all out for you, very easy.

    Hey Dappa, I'm interested in pursuing Lloyds for charges administered also - my situation is exactly the same as you described - very careless with my money back in the day, thought what the hell I can afford it. Would be nice to work out how much I can grab back off them.

    ..and some Total Tops Gold fuel credit card thing.

    God I was wreckless in my younger years!

    On another note, why can't you claim back for more than 6 years? I can not seem to find a definitave answer on the site...?

    6 years is the common statute of limitations in civil matters. You may be able to persue for more thn 6 years ago but it maybe a trickier path to go down.

    Any ideas or references as to how difficult this might be? Unfortunately/fortunately I have been pretty good with money for the last 5 years, bet for a few years before that i was a total idiot.
