if you haven't resolved it and haven't got a refund yet the escalate to a claim.
if you now have the item or your money back (or are 110% sure that you will) then close.
don't sit back and wait coz paypal will close the case and you will be left with nothing.

I believe they give them 2 weeks to reply once it's escalated. If no response is received you generally get a refund. If they do respond I believe it's up to the seller to prove it was sent (recorded delivery etc). There's loads of other bits n bobs in the terms and conditions of it but that's about it.

good luck! should be ok if you pay with paypal your insured (up to a set amount £500 i think) and as long as you play ball with them when contacted and stick to time scales as you have done here by escalating before they discard it then you should be ok. let us know of your outcome and how long it takes. how much money was involved?

DF has a Debt on the Internet Recovery Team (DIRT) dedicated to recovering online transactions Basically you get an address and those close by pay a visit and recover the funds.

Got an address? What's the amount? Post up some details and you never know.

Your actually covered for £150 to £500 depending on the sellers reputation, they also look at his previous history, to which he gets strike points. Theese arent like the strikes you get for non paying bidders. Keep any correspondence you get and use ebays messaging service so its logged. If you dont get a result at least its logged so someone else wont be fked by him

    Hope you get sorted dude

    lol just recived now :

You have chosen to escalate your dispute to a PayPal claim. By ending
communication with the seller, you are asking PayPal to investigate the
case and decide the outcome. As part of our investigation, PayPal will
review any communication you may have had in the Resolution Centre.

Thank you for contacting PayPal. We have begun our investigation of the
    following transaction:

blah blah blah blah blah blah .......................................

We will make every effort to resolve this claim within 30 days, although we
may require additional time to complete our investigation.

You will be contacted by email and asked to provide additional information.
If you are filing a claim because you believe that you received fake or
inauthentic merchandise, you may be asked to submit a letter of
inauthenticity from a reputable expert who can substantiate your claim. You
are responsible for any costs associated with this appraisal. This letter
should be on official letterhead and include contact information so that we
can discuss your case with the expert if necessary.

Your participation is essential to the investigation and it is important
that you reply to requests for information within the specified timeframe.
Failure to do so will result in cancellation of the claim and you will
forfeit the possibility of a refund.

They take ages dude, let them do wot they can. A phone call to them wont harm you and tell the person all about it. The more you keep this issue open the more they can do about it also tell them all the information you got. When they see this they will act to it

    good luck again
