Aso Mohammed Ibrahim was due to be deported after his applications for asylum and citizenship were denied.
But he has now won a court appeal against being detained while the case is being processed. He was freed by an immigration judge this week.
Jack Straw, the Justice Secretary and Blackburn MP, said he would be taking up the issue of Ibrahim's release.
The Iraqi Kurd, 31, was jailed for four months in December 2003 after he fled the scene of a crash that left schoolgirl Amy Houston dying under the wheels of his car in Blackburn, Lancs.
Months before the accident, Ibrahim had been banned for nine months for driving while disqualified, without insurance and without a licence. New laws introduced in 2007 now carry longer prison sentences for such offences.
Amy was outside her home in November 2003 when she was knocked down after running into the path of Ibrahim's car. He was later jailed for driving whilst disqualified and failing to stop after an accident.
Ibrahim has since married a Lancashire woman and has two children.
Amy's father Paul Houston, 39, of Darwen, said he was "disappointed" with the decision.
"The politicians talk big but I see no action. This man's used up so many resources no doubt at taxpayers expense but how many appeals does he get?"
Ibrahim insists it is too risky to return to his homeland in Iraq, while he also argues forcing him to leave would affect his right to family life.
A spokeswoman for the UK Border Agency said it could not say how long it would take before a decision was made on Ibrahim's case adding that they were "extremely disappointed" with the court's decision.
"This decision is by no means an acceptance of his right to stay in the country," she said.
Ibrahim will have to report regularly to a police station for the conditions of his bail.
