    Help need some advice please..

    I sold a motorbike on ebay this week that wants some work on it..

    it has no tax (sorned) no MOT and it runs like a bag of shite as it has been stood in the back of the shed for 3 years without anyone touching it at all.

    i put in the ad that it needs work to pass an MOT and told the buyer that the oil had emusified and needed changing asap before he even did anything else to it, also it was sold as spares or repair.

    So after all that he wins it then phones me up saying he will be here sunday at 6pm and he is going to ride it home...

    my question is, if he gets stopped will i get in to trouble or once the paperwork is signed is it out of my hands what he does..??

    also what if it does not make the journey and breaks down..

    You would still be the registered keeper of the vehicle as there is no way he can register it before then so you would then be liable for all the fines etc and broken laws pertaining to the use of a cehicle on a publiv highway whilst declared Off Road(SORN) so basically he cannot do that as you will be in the shit big time mate. Best thing to do is contact him and explain that you will not let him take it unless he transports it in a vehicle. You would most likely get away with it if you had the new user supplement dated correctly etc etc but its just a bit too dodgy so I wouldnt risk it. The thing is he could say he's not gonna ride it then ride it anyway which is hard to stop so best thing then would be to Draw up some sort of written consent form that anything he does is fuck all to do with you and that you want it dated and signed and two copies of it and also get your dad or family membet to witness it and sign it too. That would cover you.

    Both parties have to sign & date the V5 anyway, so use a receipt book that has carbon paper to write up a bill of sale, and make sure that receipt is timed, dated, and signed by both parties.
    It would also be a good move on your part to have the receipt signed by a 3rd person as a witness to the transaction.

    Your being the registered keeper doesn't mean shit in law, and that is confirmed on the V5 itself where it says "The registered keeper is not necessarily the legal owner"

    just to add to pegs advice,
    make a statement on the receipt that the bike is unroadworthy and must not be ridden on the highway untill repairs have been made.

    hes from oxford and going to take it down the M1..

    i am in nottinghamshire jcn 29...its 120 mile....
