    Help Appeal meeting??

    hey guys dont know if this is the right place to ask about this but here goes...

    i was recently dismised from work for gross misconduct. i had a diciplinary meeting and was told i could take a representitive with me but couldnt get one. i am going to appeal the decision and really want to take a rep this time round but have no idea who i can take. im not in a union so have no idea who to ask.

    any ideas?

    Have you spoken to the Citizens Advice Bureau? I am sure that they can help you find a rep.

    Whats the gross misconduct charge? If you dont mind me asking.......

    im being charged with a serious dereliction of duty, "knowingly" taking part in fraudulent returns and the falsification of company documentation.

    i told them from the start that i was only doing what my manager was telling me to do in regards to the returns and they tried to accuse my of doing this to get a bonus from the sales target wich i felt like they wer puting words in my mouth and using it against me. in regards to the documents it was the safe log. i filled it in correctly and because my manager took money out of the safe to pay for items she put through the tills, the safe was down so she told me to change the amount on the log and put in the ammount she told me to.

    At our place you can take a work mate in with you so if you have someone else who has been told the same thing then i'd take them in?

    dont know when the meeting is yet, need right out my appeal and send it tomorro. going go the CAB tomorro see where i stand and get advice.

    My old man went through a nasty gross misconduct charge recently, he appealed and managed to win a settlement (without going to a tribunal).
    Like mentioned above, you need to get a lawyer or someone who knows employment law really well indeed - any friends or family that can help you?

    Record down everything in any meetings you have and I mean everything. Record conversations on your mobile phone if possible so you can write a transcript afterwards - this will all help towards putting your appeal together if it comes to it.

    And don't be worried if ACAS come back with advice that isn't so much positive for your side - they aren't always correct.

    Whilst it's fresh in your head; record everything that has happened in a document/log.

    Be prepared for a long fight.

    If you are not in a Union they do not have to let you take any sort of a rep, colleague, friend or anyone else in if they don't want to. Think you will need to ask them if it is ok to take in someone else in writing,

    Surely that would also be discrimination against someone just because they are not union members. I also think you may be slightly incorrect.

    Is why I said you had to put it in writing if you wanted to take anyone.

    :edit: - sorry yes you need to ask if you want to take anyone other than a union rep or fellow employee - anyone other than those you have to ask and your employer and they don't have to let you although some will let you take family member or friend in
