    Default Court Summons & CCJ's

    This morning I opened my mail and found I had a court summons for yesterday at 09:30 - this was for apparent faliure to pay council tax.

    I rang the council and they said that I had payed it but had not kept in line with the payment schedule - they received 2 payments late this year (5days) I always post it so it was probably a postal delay.

    I said to the chap to send me a direct debit and ill fill it out - he said to reply with a letter explaining this.

    What I was wandering is how do you get a CCJ and do I now have one for faliure to be at court ?

    If I do have one can I get rid of it becuase this is not my fault - it all seems a bit over the top for a 2 late payments !

    What should I do ?

    And you should get a life. Don’t reply if all you can come up with is crap. It’s a waste of my time reading it, a waste of my time writing this reply and probably a waste of your time typing that - but seeing as you have no mates, you probably spend all day and night in front of your PC with nothing better to do, then.....well.....

    Ok, your best bet is to contact the clerk of the court and explain whats happened first of all. YOu do realise that failing to attend court, even for that, can lead to a warrent for your arrest dont you. Get that sorted first as you dont want to get nicked.Also explain that you recieved the letter the day after you were meant to be at court. Keep the envolope if it has a post marked date on it. Also may be worth calling the local station to speak to the warrents clerk in the Criminal Justice unit or the Crime Support Unit (not sure what name they offically go under anymore) and tell them what happened.
    Then write a stern letter to the council explaining the situation and say all payments are sent on time and that it is a postal or there admin error causing the delay.
    Get the above done asap and hope fully no CCJ will be occured

    you cant get rid of a CCJ, if you want to get a lone ect you will have a hard time getting it if ya get a ccj

    Martintana - thanks for your advise. I will write a letter to the clerk of court and to the council, hope fully this will sort every thing out.

    Are you told by a letter is you do have a CCJ ?

    usualy its just a threat wich they dont follow on with. its just to scare you in to paying ,they usually say you have to pay rest up front but its bollocks just phone them up and dont worry

    Dont worry you cant get issued with a warrant for your arrest thats bollocks. Its a civil matter not criminal.

    I had this happen to me... and the council traced me to my new address and by the time I got the court summons its was so close to the court day.. I decided to go to court.

    Its nothing really if you lose, which I did I only had to pay an extra $80 as it was dealt in the small claims court they cant make you pay for their lawyeres.

    The best thing to do is pay it *IF YOU ARE IN THE WRONG* if not go argue with their lawyers.

    They might decide to break a deal with you before you go into court room in the hall.. if they do shake their hand and TAKE IT!

    BTW: I have had two CJs against me.. and they did not affect my credit as I took control of a bank computer once and searched myself and nothing turned up (im clean)
