Default Screwed over by Apple and T-Mobile

First off,I have not open or let anyone else open my phoneapart from the people from the Apple Store.
I had aproblem with my 3 month old 4S took it into the genius bar, they said it wasfaulty and needed to be replaced, they took it into the back of the store and acouple of minutes later came back with the phone minus back cover and showed methe insides they said that there was 4 missing screws that go up beside thebattery and camera that are missing and that the phone had been tampered with.I will say again this was not done by me for the sceptics, the guy from thegenius bar said that the phone was otherwise perfect no marks of being openedand that the fault I was having would be correct for the phone missing thesescrews. He sent me back to the network store that I got the handset from sayingthat it was their responsibility as they or the distributor must have sold me arefurbished handset as there was no way the handset could have came Apple likethis.
The network store said it's Apples problem asthey don't have a service agreement with them and can’t even sell returnedhandsets they all need to be immediately returned back to Distributorimmediately. So now I'm stuck with a phone that won’t work and neither of thesemassive companies are willing to responsibility for.

More to the point they presumably have a record of your first vist, you don't get a genius bar appt. without there being a record. Pointless to put screws in at this stage. . .

Id go back to the apple store and get them to take another look. If its a a refurbished handset they should be able to track the history of the device?

kick up a stink in the store they will soon bow down and sort you out.
Only in Britain….do we use the word “politics” to describe the process of Government. “Poli” in Latin meaning “many” and “tics” meaning “bloodsucking
    creatures”

Yeah it's the point of having no further cover from them that's the killer from me, when I was in there they couldn't be bothered in it's history just slating T-Mob and saying it's all there fault, they wouldn't even listen when I said that the handset was vacuum sealed in the proper box with correct numbers on. Dealing with the Apple store manager was like talking to a stuck record. I did manage to get the email address for the area manager and have sent him the details but got nothing back from him, not even a generic tough shit mail.

    No it does happen.
Repair them often have had phones from apple missing screw's it happens.
Best to try ringing apple and talk to customer relations.
    Be adamant about your case.

What was the fault with the phone ?

Exactly, talk to them on the phone, lay it all out to them and get it replaced by them. Won't hurt to mention trading standards in a 'friendly' way "I really didn't expect to have to involve Trading Standards in my dealings with Apple, they have always been fantastic" etc. etc.

I'm waiting on both T-Mob and Apple via email at the moment, will see what they say. The fault I was getting was No Sim installed and the Activation Required, the screws that are missing are up the same side as the sim tray so that's probably why it's happening. My next step if I don't get sorted with the emails it's going to CAB and Trading Standards.
