    ebay eBay advice - item received but faulty

    Hi all,

    I don't use eBay much these days as it's full of tossers.

    This was further proven when the tablet I bought turned up and didn't work.

    I contacted the seller and he stated it worked ok when he sent it and he wasn't going to accept a return.

    I immediately opened a case stating item not as described and have repeatedly asked the seller for a return address, which he has refused to supply.

    eBay say he has until 20th to respond but I was wondering how I stand if I haven't been able to send the item back to him ?

    Any advice ? It's been a while since I was involved in a dispute.

    As business seller on ebay, not one of the tossers - you have done it the right way. By contacting him direct first, he's rejected that offer, so opening a case is the way to go. Wait on the outcome of the case and you will be able to get a refund. Did you pay through PayPal? If so you'll be golden.

    Distance Selling Act has got your back on this one - if it IS a business.

    PayPal will refund the cash under Distance Selling and if the seller doesn't give details to send the item back, it'll end up being yours anyway.
    PayPal/eBay will give you the return address, but if he doesn't want it back, you'll get a refund and get to keep it.

    eBay has turned on Sellers in this way of late and although unfair in some circumstances, as a buyer, it's superb.

    If it's a private seller, if it states that returns are not accepted, you might not get as much luck.

    But if it's in 'perfect working order' and arrives knackered. It could also mean its been damaged in transit - not your problem and should have been packed securely.

    It's a private seller and his pics show it working but it's doa. Tried different chargers Etc and also checked his chargers and they are ok. Either he's pulling a fast one and the pic is a different one or it's quite simply gone faulty. He does state no returns in the ad BUT it's sold as fully working so as I said I've filed it as not as advertised.

    I wasn't sure if the distance regs applied or not as he's a private seller BUT it was a Buy it Now auction.

    Even if it's a private seller, if he says it's working in the listing and it's not when you get it, you can still request a refund through PayPal and I'm fairly sure they will just credit you and debut him.

    Stating no returns does not wash with PP or ebay, if its sold as working and doa then you will be refunded, you just have to wait it out for the the seller to reply/or not and ebay will decide when the deadline comes, generally in the buyers favour.

    sounds like might been trying it on and sent you another unit, done it the right way so fingers crossed, i had this before and made a video and sent to to seller showing not working

    This banner is all over ebay at the moment, so as stated, if you paid by paypal in the usual way (not gifted) then you'll be fine you just have to wait a little while.

    yep it was a standard Buy it Now, I paid using the paypal link in the sale. Should be all covered.

    He's still refusing a return address so I'll have to wait until the 8 days or whatever it is are up, which will be the 20th. I'll keep everyone posted.

    Hi all,

    I escalated the case on the 20th and eBay provided me with a prepaid address label.

    I sent it off and as soon as it was delivered this morning I got my full refund.

    It's a shame it's took so long to sort out. People like that are what give ebay a bad name. At least you got your money back!
