    Advice Buyer didn't read listing

    Hi Guys,

    Sold an item on eBay yesterday which clearly states payment via Bank Transfer or PayPal Gift only as the total fee would be £12-14.

    Buyer paid via normal PayPal method which I immediately refunded (contacted him as well) and now they are holding the payment for "5-7 days" which is clearly taking the piss when they have access to my bank account/debit card so could easily take it immediately.

    Any advise before I phone them in the morning?

    If he's paying by paypal for an ebay auction, does that preclude it from being a gift? Also, does it mean the buyer doesn't get buyer protection?

    You may be in a tricky position tbh mate.

    Would be careful about phoning them as you are evading paying the fees and paypal are a part of ebay

    You can't specify PayPal gift on an eBay sale, PayPal IS eBay and you are stealing their fees, at the very least it will be against the T&Cs
    If at first you don't succeed.....redefine success. . . .

    Surely it is against the EU fairness law "cant remember what it's proper name is" as it is unfairly forcing sellers to use PayPal. Just like Microsoft forcing its users to use IE

    In this case, you won't have a leg to stand on. Once eBay get involved - if the seller reports it - you could be get some stern warnings from eBay for trying to circumvent their fees. Suck up the £12 and put it down to experience... I'm guessing you haven't taken into consideration the percentage eBay swipes for selling it either yet...

    Usually it's 10% of the overall selling price (called Final Value Fee) as well as the Paypal fees.

    Totally agree it's a piss take they should be taken to task by Trading standards, office of fair trading etc but these organisations the people fund are too busy protecting big business and have no interest, also there are stolen and fake goods sold every hour of the day on Ebay yet nothing is done, you may say well the volumes that go through, difficulty checking etc etc but this is not the point as the law is supposed to be equal and if you had a little shop you allowed people to sell things in and you take a cut of the sale I would give it a week before the police visited you and a month before you got charged with handling stolen goods.

    Try the defence that you couldn't check everything and see how you get on then consider Ebay check nothing, as for the Paypal gift thing I agree with others and think you will get screwed trying to get payment as gift for an Ebay sale as the same company own both Paypal and Ebay... hmmm isn't that another monopoly we should have a monopolies commision

    Apparently the refunds down to the bank so I'll go in to speed things up to avoid the PayPal conversation.

    I've removed the PayPal gift stuff from the other auctions although it doesn't state that I cannot do it. The buyers a Cambridge university lecturer.

    Once this passes I'll create a government petition thing!

    Buyers are also reluctant to not use paypal for the guarantee it gives. a buyer will hardly ever lose a case so it makes sense to use it to pay.

    That's one of my main issues. I've stuff recorded delivery before. Item was signed for, buyer said they never received the item and PayPal just refunded it. No questions asked. I was out of pocket £120 + phone.

    Yeah takes the michael, I only buy off of there now, too much in the buyers favour if selling and guaranteed a loss if you are the seller.

    Not fully of topic, but I dont use eBay any-more as a seller and only use paypal as a buyer. I just got sick of costs going up and up, I only used to toy and put small items, usually pence. It then became a game of breaking even and then finally it was too much of a headache.

    Taking Blabbouncers comments on, is there no means of the common man, many of said user, complaining to Trading Standards?

    I have little doubt they have 1000's of complaints but choose not to, the difference is at best they will ask them to try harder but if it was small businessman he would be dragged away in handcuffs, his business and home ransacked and even if found innocent his business would be in the toilet.

    eBay charges are ridiculous. They must be using £50 notes to wipe their arses in the head office. I sold a phone a few months ago for £250 and ended up paying almost £30 in charges between Paypal and eBay. I see a lot less individuals using eBay these days and turning to things like Gumtree to sell on.

    Anyway as far as ebay/payscam are concerned this is exactly the reason I no longer sell anything on ebay.. occasionally purchase as I dont have to worry about fees/cuts

    Edit: although I dont use it I am told a lot of selling now occurs via facebook groups ... a lot of people getting tired with ebay's monopoly
