Honeymoon murder suspect Shrien Dewani to be extradited

Jon Kay reports: "He's said to be suffering from severe post-traumatic stress disorder and depression"

A man accused of arranging his wife's killing on their honeymoon is expected to be extradited to South Africa later.

It follows a three year legal battle by Shrien Dewani against returning to the country where his wife Anni, 28, was shot in November 2010.
Mr Dewani, from Bristol, denies murder and lost his latest appeal against extradition in March.
The couple were held at gunpoint while being driven in a taxi through Gugulethu township near Cape Town.

Mr Dewani was thrown from the car. The body of Mrs Dewani was found the next day in the abandoned taxi with a single gunshot wound to the neck.
Three men have already been convicted in connection with Mrs Dewani's death. Prosecutors in South Africa allege Mr Dewani ordered the killing of his Swedish national wife.
Mr Dewani's legal team still have the option of applying to the European Court of Human Rights, but so far no application has been received.
The businessman, from Bristol, is expected toarrive in Cape Town on Tuesday..
Once on South African soil he is likely to appear before the Western Cape High Court where his legal team could apply for bail.
If that is refused, he will be taken to the high-care wing of Valkenberg, a psychiatric facility, the BBC's Karen Schoonbee in Cape Town understands.
Ashok Hindocha, Anni Dewani's uncle, told ITV's Daybreak that the family would attend the court hearing.

"We want to know what happened to Anni. That is it," he said.

The extradition has made front page headlines in South Africa

Anish Hindocha, her brother, added: "We are just focusing on this case at the moment and it is hard to even start making the grieving process final yet because there are so many questions we need answers to.
"We hope we get it and now today he is getting extradited and that is one step closer towards what we are seeking for her - that is justice for her."
Mr Dewani is being compulsorily detained in the UK under the Mental Health Act after being diagnosed as suffering from severe depression and post-traumatic stress disorder.
South African Xolile Mngeni was convicted of premeditated murder for shooting Mrs Dewani and jailed for life.
Prosecutors claimed he was hired to carry out the killing.
The couple's taxi driver, Zola Tongo, was jailed for 18 years after he admitted his part in the killing and another accomplice, Mziwamadoda Qwabe, also pleaded guilty to murder and was sentenced to 25 years in prison.

Mr Dewani could be held in Valkenberg psychiatric hospital, the BBC understands

I think the huge media publicity and bags of money for defence council should ensure he gets a fair trial in SA.

Been a big story locally for me as he lived in Bristol so on the local news a lot. Its really hard to imagine why he would have her killed but that's not to say he wasn't involved. Also was there pressure on the 2 convicted to implicate him to deflect attention away from violence in the country? Lots of what ifs and it seems the evidence against him is the word of 2 men convicted of murder.

I was surprised he didn't win the appeal against extradition due to this and deals being done with them but I think it's the right result in the end, as for guilt I don't know what the reasons might be but I think he is guilty.

A British millionaire accused of murdering his wife on their honeymoon in South Africa has told a judge he is bisexual.
Shrien Dewani, 34, denies orchestrating his wife's death by hiring three men to kill the 28-year-old as they drove through Cape Town's Gugulethu Township on 13 November, 2010.
Appearing at Western Cape High Court in Cape Town, the care home owner denied charges of murder, conspiracy to commit kidnapping, robbery with aggravating circumstances, kidnapping and defeating the ends of justice.
He told judge Jeanette Traverso: "I plead not guilty to all five counts, my lady."
Through a witness statement read to the court by his solicitor Francois van Zyl, he also told the court he was bisexual.

Video: Anni Dewani's Family Want Justice
In it, he said: "My sexual interactions with males were mostly physical experiences or email chats with people I met online or in clubs, including pr0stitutes."
Footage of the crime scene, including Anni's body inside the taxi, were also shown to the court.
The court heard Dewani had abnormally low levels of hormones and that he and his wife were unlikely to have children. He said he had discussed this with Anni, whom he began dating in summer 2009.
Their relationship broke down, but they got back together in March 2010 and married later that year in Mumbai.
Dewani said the carjacking in Cape Town was a "traumatic experience which resulted in the loss of my wife".
He added he has suffered "flashbacks, nightmares and anxiety attacks" since, which has affected his ability to remember clearly.
Mr van Zyl said his client remembered banging noises coming from the front of the car during the carjacking.
Dewani added: "The next thing I recall is somebody next to me, who told me to lie down. The person had a gun in his hand. He was waving the gun in the air."
Anni Dewani's family, including her father Vinod Hindocha and mother Nilam, were among those in a packed courtroom on Monday.
Prosecutors claim Dewani conspired with Zola Tongo, Mziwamadoda Qwabe and Xolile Mngeni to kill his wife. All three are already serving jail terms in connection with Anni's murder.
He claims he and his wife were kidnapped at gunpoint as they drove through the township.
The court heard Anni Dewani was screaming inside the taxi and he was ordered to keep her quiet as they were driven by another driver. Dewani said he was ordered to get out of the car with a gun to his head and he had to climb out of a window because the door would not open.
He added: "The last thing I had said to Anni was to be quiet and not to say anything."
Dewani was released unharmed, but his wife's body was found in the abandoned taxi the following day with gunshot wounds to the hand and neck.
Before the trial, he was detained in a hospital in Britain with depression and post-traumatic stress disorder and has spent the last three years fighting extradition to South Africa.
It is unclear if Dewani will give evidence in his defence.
    The trial continues.

Shrien Dewani 'agreed price for wife murder'

Shrien and Anni Dewani were on honeymoon in Cape Town in November 2010 when she was killed

British businessman Shrien Dewani agreed to pay about £1,300 to a hitman for the murder of his wife Anni in South Africa, a court has been told.

On the second day of the trial in Cape Town, Mziwamadoda Qwabe said he was asked to make it look like a hijacking.
Mr Dewani, 34, from Bristol, denies murdering his wife Anni, 28, on their honeymoon in 2010.
The couple were held at gunpoint while being driven in a taxi through Gugulethu township near Cape Town.
Qwabe told the Western Cape High Court that taxi driver Zola Tonga had told him "there was a husband who wanted his wife to be killed".
Mr Dewani faces five charges, including murder and lying about the circumstances of Swedish national Anni's death.

Mziwamadoda Qwabe has already been sentenced to 25 years in prison for the murder of Anni Dewani

Qwabe, from Cape Town, was sentenced to 25 years in prison in 2012 for the murder of Anni Dewani.
Prosecutors claim Mr Dewani conspired with him, and other Cape Town residents Zola Tongo and Xolile Mngeni.
Qwabe, 29, told the court Tongo phoned him and said he had a job that needed to be done - that someone needed to be killed.
He said Tongo agreed to meet him the next day to discuss the murder, and a price of 15,000 rand (about £1,330 at the exchange rate at the time) was agreed.
The pair then arranged to meet up with Tongo's taxi for the attack, during which Mr Dewani's phone would also be taken.
He told the court the money was due to be left in a "cubby hole" in the vehicle which would later be split before the pair spent an evening "socialising".
Qwabe was asked if there was any discussion about a weapon. He said: "I knew there would be a firearm involved."
He told the court Tongo called him later and told him the route the taxi would take on the evening of 13 November 2010.

Shrien Dewani, who is on trial in South Africa, denies any involvement in his wife's death

Describing the carjacking, Qwabe said: "[Mngeni] had the gun. As it [Tongo's car] approached I got into the driver's side.
"[Mngeni] got into the passenger side and Zola got into the back. I saw in the (rear view) window a guy and behind me was a lady," he said.
"I ordered Zola to get out of the car. He told me the money was in a pouch behind the front passenger door.
"I stopped the vehicle, I asked the husband to get out of the car.
"The husband was now out of the vehicle and I drove on."
Qwabe told the court he was behind the wheel when Anni was fatally wounded.

Anni Dewani was killed in the back of a taxi in South Africa

He said he was concentrating on the road at the moment Mngeni killed her.
"I heard a gun shot. [Mngeni] said 'I shot the lady'.
"I pulled over on to the pavement and stopped the car. I saw she [Anni] was on the back seat of the car."
Qwabe said he found the bullet casing then threw his gloves away.
He told the court 10,000 rand was in the pouch and 4,000 rand was seized from "the husband".
Qwabe admitted he had lied in court at a bail hearing before he admitted his guilt over the murder.
Francois van Zyl, representing Dewani, said: "At that bail hearing you testified under oath, you pleaded not guilty because you said you had an alibi. Is that a lie?"

Anni Dewani's father, Vinod Hindocha, was among family members to attend the trial in Cape Town

Qwabe replied: "My lawyer at the time told me to plead not guilty."
Mr van Zyl said: "I repeat the question. Was that a lie under oath?"
    Qwabe answered: "Yes."
The court was told there had been no conversations with Tongo about how Anni would be killed, only that it had to look like a hijacking.
Mr van Zyl asked: "You never had a discussion about how this woman was going to be killed?"
    Qwabe answered: "No, sir."
He told the court it was not decided who would strike the fatal blow, what weapon would be used, or where the killing would take place.
On Monday Mr Dewani told the court in a written statement that his "whole world came crashing down" when his wife was found killed.
He also revealed to the court that he is bisexual.
A record of agreed facts in the case, released by the court on Wednesday, showed he had been browsing same-sex dating websites during the honeymoon and within days of his wife's death.
It shows he was logged into the Gaydar website while waiting with his wife for a connecting flight to Cape Town, and three times between November 15 and November 16, He also logged into the Recon website twice.
The trial was adjourned until Thursday.

Shrien Dewani murder case thrown out by South African judge

Shrien Dewani has been found not guilty of arranging the murder of his wife, Swedish national Anni Dewani

A judge has dismissed the case against Shrien Dewani, who was accused of arranging the murder of his wife Anni in South Africa.
Judge Jeanette Traverso said the evidence presented by the prosecution fell "far below the threshold" of what a reasonable court could convict on.
She said the evidence of the prosecution's main witness, taxi driver Zola Tongo, was "riddled with contradictions" and "highly debatable".

Mr Dewani will now be released.

Announcing her ruling, the judge said: "The accused is found not guilty of this charge."

She said the only reason not to grant the application would be in the hope that Mr Dewani would implicate himself if he gave evidence.
But to do so would be a "manifest misdirection", she said.

Ami Denborg, the sister of Anni Dewani weeps as she walks away after making a statement expressing the family's shock at the South African justice system

Speaking outside court, South African National Prosecuting Authority spokesman Nathi Ncube said: "It is unfortunate that Mr Dewani has been acquitted because we believe that he was involved."

He said: "The court did not find that he was innocent, the court said it could not rely on the evidence given by three witnesses who themselves had been convicted of the crime."

Mr Ncube also denied that the case had collapsed because of a "shoddy police investigation".
He said: "The judgment centres around evidence that was given by three people. Nothing has been said about the police, nothing was said about how the prosecution could have done better.
"The fact of the matter is that we were relying on people who were themselves involved and implicated in the case."
Mr Dewani, from Bristol, was extradited to South Africa this year to face trial accused of planning the murder of his wife in November 2010.
He listened intently as key evidence against him was criticised by the judge as she gave her ruling over almost three hours.
Mr Dewani, 34, went straight down to the cells to prepare for his release, following the decision, as his family embraced.
Mrs Dewani's family, who had said it would it be a "nightmare" if the trial did not continue, immediately left the court room.

Prosecutors said bisexual Mr Dewani had long planned to get out of the relationship to Swedish-raised Anni

They bowed their heads amid shouting from the public gallery.

In a statement read outside the Western Cape High Court, the Hindocha family said: "We feel really, really sad because we have not heard the full story. Shrien lived a double life."
Mrs Dewani's sister, Ami Denborg, later said: "The justice system has failed us."
Her brother, Anish Hindocha, had last week implored Mr Dewani to "tell the world what happened the night she died".

But the judge ruled it was not necessary for him to give evidence, saying a defendant was entitled to be discharged if there was no possibility of conviction unless he entered the witness box and incriminated himself.
The judge said the evidence from the three criminals already convicted over Mrs Dewani's murder was "so improbable, with so many mistakes, lies and inconsistencies you cannot see where the lies ended and the truth begins".
Dewani, 34, has always denied plotting with others to murder his bride, who was found shot dead in the back of their taxi after the couple were hijacked during a late-night tour of a township.
Prosecutors said bisexual Mr Dewani had long planned to get out of the relationship to Swedish-raised Anni, and arranged the attack in which he would escape unharmed and Anni would be killed.
Judge Traverso said it was crucial for the state's case to prove that Mr Dewani entered into an agreement with others to have Anni killed.
Tongo was the only accomplice witness, she said, adding that such evidence should be treated with "caution".
Tongo's version needed to be corroborated specifically where it implicated the accused, she said.

    'Intelligent men

    '
Details such as where he picked up and dropped off Mr Dewani and his wife did not provide corroboration, the judge said.
It is what was said during these events which is at issue and for that there is only the version of Tongo, she added.
She said the same applied to phone calls between Tongo and Mr Dewani.
"This telephone communication does not in itself corroborate what was said during those calls, it merely confirms that communication took place."
The prosecution had alleged the men carried out the killing for Mr Dewani for 15,000 rand (about £830).
The judge said Tongo and accomplices Mziwamadoda Qwabe and Xolile Mngeni were "intelligent men" and dismissed the prosecution claim that they would have carried out a contract killing for Mr Dewani for "a few thousand rand".
Tongo is serving an 18-year jail term for his role in the murder and Qwabe is part-way through a 25-year jail sentence for his role.
Mngeni was serving life for firing the shot that killed Mrs Dewani, but died in prison from a brain tumour.
The judge confirmed Monde Mbolombo, a self-confessed "link man", would no longer be granted immunity for his part in the plot.
The hotel receptionist admitted telling lies to the court to protect himself when the investigation first took hold. He had initially been granted immunity by prosecutors in return for being a state witness.
But the judge said: "As his evidence progressed, it became more and more clear of his involvement."
It will now be up to prosecutors to decide whether Mbolombo should face criminal proceedings.

Not really surprised as I had doubts on him being extradited in the first place due to the 'deals' done with prosecution witnesses and tainted evidence although I have little doubt he was involved when you start giving incentives to witnesses to lie you never really get to know the real truth.

Another thing I can't help wondering is whether wealth pushed them into the doomed marriage?
Both from wealthy families, pressure from his family to conform and find a bride even though his heart may have not been in it. And equal pressure from her side to go through with a marriage that was beginning to look and feel like a sham (they had vicious arguments before and after their marriage). I don't think there is a question that the union was arranged, and just like a sheep to slaughter he went through with it until he felt well and truly trapped.

Not an exceptional suprise from the SA legal system if we look at another recent high profile case where someone almost walked (is that too bad of a pun?)
