    Question insurance offer from accident

    i was involved in a car accident recently.
    100% liability accepted by other party as they crashed in to me.
    minimal damage to the car, I went to hospital and suffered whiplash injuries. dr at hospital, GP and 3rd party assessment say so.
    I had 4 days off work. but could not afford anymore as Im self employed and need to work.

    his insurance have said they offer £1000 settlement. the solicitors provided by my insurance tell me this but do not offer any advice on whether to take it or not.

    So question...
    should you accept the first offer??

    Nope.

    My friend works for one of the large Supermarkets and is a corporate lawyer for them and has to deal with all the claims made against the stores in the area, 1st offer would be something like £5k but would have a budget for the case of £15k.

    What's the worst that can happen if don't accept their first offer do you think they go to court over it when its such a one sided case?

    If you think £1000 covers any expenses you've paid out, time taken off work to go to doctors, the physical pain you were in, etc. then take, it if not don't. Personally I think £1000 is a bit low. They are just trying their luck.

    I'm not accepting it, solicitor has been informed.

    its not really about the money.
    the guy in the car was a right knob. arogant isnt even the word. even when his passanger whom I assume to be his mother was in shock and shaking, his attitude was shite.

    "nah, you're alright mate, only a scratch that" , " she'll be alright, she's a bit of a drama queen"

    3k Documented whiplash claims sy average is £3k. If you are still in pain weather working or not then the payout can and should be bigger. Get recent docs note stating any continuing medication for pain ect and to list the present status of your injury. If you still suffer from the injury then I would laugh in their faces at £1k and tell them to add a zero. It will look better for you if you are receiving treatment and if you go to osteopathy ect then any compo would also include this.

    Yes it is. Why short yourself because someone else can't drive? You are self employed and had to take days off because of this guys mistake.

    i have letter from physio link stating I would benefit from some physio therapy.

    Its not just the short term injuries you need to think off.
    A friend of mine was in a similar situation a while back, he declined the 1st offer based on the fact he needed further sessions with a physio etc.
    He ended up with £3750 after some haggling, he is also self employed and his work really suffered as he his a sound engineer so heavy lifting & lots of driving involved.
    Anyway its like 12 months since his payout etc and he's still having back problems which have obviously stemmed from the accident & in need of weekly physio to maintain the ability to work.
    Just think about the offer mate.

    You shouldnt settle until you know the extent of the damage. If you need to see a physio you should see them first and see how many sessions you need etc. The settlement should take all this into consideration. This is probably why they want to settle as soon as possible. Take things slowly and the more inconvenience you have the more they should offer you.

    rule of thumb refuse first three offers but also do seek proper medical advice and do remember any possible longer term damage the gits will try get you away as fast as possible

    I have my first physio session next tuesday evening. I guess thye will then decide how many / how long I will require it for.
    another assessment is booked for beginning of October.

    Just remember once you accept, it's a full and final settlement. Make sure the quacks give you some sort of long-term diagnosis based around your physio. Don't worry too much about dragging it out for as long as necessary.
    As for the other guy and his attitude, none of this now is affecting him, money wise or other. Once he's told his insurance (and possibly been asked for a further statement now you're claiming) he's cut right out of the loop.

    def not i just had my rta sorted also 100% their fault i refused the first 3 offers £1000,£1800,£3000 told them i rather go to court we settled on £11k although my injuries were more serious than yours

    I thought car claims like this were capped (just sticks in my head as woman are capped at a few hundred more than men)?

    If its to cover legitimate time for physio etc I don't see why not. What should stop is fake claims just to get more cash out of the system.

    not capped but there are guideline brackets mine fell into the bracket of between 5k to 7.5 k this guideline is just for type of imjury suffered you then add loss of earnings etc

    why?? i was off work 6 months had to have surgery all through no fault of mine why shouldnt i ba able to claim??

    I used to think this but the last couple of years are beginning to change my mind.....

    I have been in a couple of accidents in the past(6-10 years ago) and have always said no to insurance claims etc. even when I had suffered whiplash and never thought anything more of it until recently. I now have back problems for the last 4 years(slipped disk, prolapsed disk, and a sirynx cyst). I have seen two NHS neurosurgeons and one private neurosurgeon and all three have independently stated they are 90% sure these problems result from some form of spinal injury most likely car accidents.

    I have now had physio, MRI scan, X-ray, blood tests, and am possibly looking at spinal surgery, rehabilitation, loss of sensation in arms and movement in later life. Most of this has been at my own cost and I am now planning for future costs.... I am already somewhere in the region of £4000 for consultations, treatment and tests so far and I am wondering how much I could need in the future...

    I'm not bitter about, but do wonder if I should have claimed when it was offered.....

    I think what we need is a fairer system where immediate treatment(say in the first 3 months) is paid for straight away directly by insurance but also treatment from years later is also paid for, but directly by the insurance. This may stop the claims being pocketed for personal gain, I don't know the answer but we do need a better system....

    The insurance industry have done a great job convincing the public to feel sorry for them and their profits. Let's just imagine for a min that there were no insurance for injuries in car accidents....bit like sign a waiver when you go go carting type of thing. Do you really think for even 1 second that your insurance premium would go down ? Insurance companies are scum and are always on bleating about something that is a "danger" to their profits whether it be whiplash or bad bloody rain they are always bloody moaning about it and the claims. Maybe these insurance companies should take out some insurance.
